It is a commercial enterprise if it consists of a holding company and its wholly-owned subsidiaries are engaged in a profit activity. Non Commercial activities, such as owning a personal residence, are not included in the term as long as each subset is included.

A qualified EB-5 investor must make the required investment in a business that will generate at least 10 full-time positions for qualified employees.

To qualify for state revenue a new commercial enterprise must directly create the full-time jobs to be counted. New commercial enterprises located within a regional center may do so directly or indirectly by creating full-time jobs.

Direct jobs establish an employer-employee relationship between the new enterprise and its employees.
