Job Creation Requirements:
A qualified EB-5 investor must make the required investment in a business that will generate at least 10 full-time positions for qualified employees.
To qualify for state revenue a new commercial enterprise must directly create the full-time jobs to be counted. New commercial enterprises located within a regional center may do so directly or indirectly by creating full-time jobs.
Direct jobs establish an employer-employee relationship between the new enterprise and its employees.
The new commercial enterprise may not directly create jobs but will result in indirect jobs. When an EB-5 investor invests in a troubled business, job maintenance may be a viable option.
