Hi everybody. This is Jerry Gerritsen Tabia Law. We are here today speaking about this new program in the Biden administration called Processes for Cubans, Haitians Nerons, and Vin Venezuelans. All right, so let’s get started. The most important thing with this new program is the I 34 A. Make sure that you’re not filling out the I 1 34.
That’s not the right form. It has to be the I 1 34 A. If you do the wrong form, it’s not gonna work. You have to start over from scratch. So make sure it’s a I 1 34 A and basically what that is, it’s the sponsor, the party that is bringing you over the beneficiary, over the foreign party. over the American is the person that is sponsoring the foreigner, not only sending in the application, but also by finance in financing that situation.
Now, if the beneficiary has money, that’s fine, but the government still wants the I 1 34 A filled out to prove that if the Ben. Doesn’t come through financially when they come over here that the sponsoring party will be liable for that person that they’re bringing over financially. And that if the, if they, the foreigner goes on a public charge or they, they get government funding, that the sponsor may, or that they are liable for that to reimburse the government for those monies.
So it’s. important in that sense. Now the other aspect is that the I 1 34 A is the travel document, so that is the item that gets them into the country. Generally, the I-34 is just for the financial and to show that the party that is sponsoring you that they’re gonna be able to support you. But in this case, that’s why it’s different.
The I 1 34 A, it’s also the. travel document in other situations where you have consular processing cuz the person’s outta the country and they’re going to the local consulate or embassy to get their visa. The I 1 34 is just to show the financial support because there’s an underlying visa that is actually the actual travel documents.
Your F1 student visa or your L P r legal, permanent resident green. Or your H one B visa. So there’s, there’s always generally an underlying visa that’s the travel document that gets you here. But in the I 1 34 is just the financial aspect of it. But here it’s both. It’s not only the financial document that’s, that’s proving that the sponsor can financially support you while you’re here in this country.
But it’s also. The travel document to get you from A to B from your country, from Haiti, from Cuba, from Nicaragua, or Ben ela. That is what you’ll be using I 1 4 34 A because there’s no underlining visa. This is a temporary parole situation. You’ll be in the United States for two years on this program. And that’s, that’s the instrument, that’s the travel document that gets you into, Port of entries.
